1. Agreement to Terms

By accessing and using RECORDER-ED ("the Platform"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not use our services.

These terms apply to all users including students, teachers, parents, guardians, and visitors.

2. Account Registration

  • You must be at least 18 years old to create an account
  • Users under 18 require a parent/guardian to create and manage their account
  • You must provide accurate and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3. Acceptable Use

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon intellectual property rights
  • Transmit viruses, malware, or harmful code
  • Harass, abuse, or harm other users
  • Impersonate others or provide false information
  • Interfere with or disrupt the Platform
  • Attempt to gain unauthorized access to any part of the Platform

4. Services Provided

4.1 Private Lessons

  • Teachers set their own pricing, availability, and policies
  • Students must apply and be accepted by a teacher before booking lessons
  • Lessons must be approved by the teacher before payment
  • The Platform facilitates the connection but is not a party to the teacher-student relationship

4.2 Workshops

  • Registration and payment are required in advance
  • Workshop details (date, time, location) are specified at registration
  • Cancellation policies are set per workshop

4.3 Online Courses

  • Courses are self-paced and accessible upon enrollment
  • Course access is generally non-refundable once content is accessed
  • Course materials are for personal use only

5. Payments and Fees

5.1 Payment Processing

  • All payments are processed securely through Stripe
  • You agree to provide valid payment information
  • Prices are displayed in GBP and include VAT where applicable

5.2 Platform Commission

  • The Platform charges a commission on transactions
  • Teachers receive their share after platform commission is deducted
  • Students pay the full lesson/workshop/course fee

5.3 Refunds

  • Refund policies vary by service type (lessons, workshops, courses)
  • Private lesson cancellations must be requested through the Platform
  • Cancellations made 48+ hours in advance may be eligible for refund (minus platform fees)
  • Workshop refunds are subject to the specific workshop's cancellation policy
  • Course enrollments are generally non-refundable once accessed

6. Intellectual Property

6.1 Platform Content

The Platform and its original content, features, and functionality are owned by RECORDER-ED and are protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

  • You retain ownership of content you upload (sheet music, materials, etc.)
  • By uploading content, you grant us a license to store, display, and transmit it as necessary to provide our services
  • You represent that you have the right to share uploaded content
  • Do not upload copyrighted material without permission

7. Teacher Responsibilities

Teachers using the Platform agree to:

  • Provide accurate qualifications and experience information
  • Maintain appropriate professional conduct
  • Honor scheduled lessons and workshops
  • Respond to student requests in a timely manner
  • Comply with child safeguarding requirements where applicable
  • Report any concerns about student welfare

8. Limitation of Liability

The Platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law:

  • We are not liable for the quality or outcome of lessons, workshops, or courses
  • We are not responsible for disputes between teachers and students
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid to us in the past 12 months

This does not affect your statutory rights as a consumer.

9. Child Safety and Safeguarding

We take child safety seriously. Teachers working with children must:

  • Comply with UK safeguarding requirements
  • Report any safeguarding concerns immediately
  • Follow appropriate professional boundaries

Parents/guardians remain responsible for supervising their children's online activities and lessons.

10. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Fraudulent or illegal activity
  • Conduct that harms other users or the Platform

You may delete your account at any time from your account settings.

11. Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

We encourage users to contact us first to resolve disputes informally.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a prominent notice on the Platform. Continued use after changes constitutes acceptance of the updated Terms.
